Whereby Hodari Africa Safaris Limited agrees to grant the Agent the following terms & conditions set out herein, for the Name of Tour as per the accompanying itinerary.
It is clearly understood that any bookings made between the AGENT and Hodari Africa Safaris Limited including, but not limited to, its affiliates and/or its partners are governed by the Terms & Conditions set-out herein. For the avoidance of doubt the governing legal jurisdictions will be The Republic of Kenya.
* Confirmation of Booking.
A booking will only be confirmed upon receipt of deposit payment. Please ensure that you indicate the following information:
- Name of the Tour your guests will be joining – in this case: Name of Tour as Per Itinerary
- Date and time of arrival and departure flights
- Number of pax.
- Names of your clients, their ages and especially of any children in the group.
- Any special requirements
- Nationality of Clients

*Amendments & Cancellations.
Any further amendments or cancellations should follow the same procedure.
*Payment & Deposit Policy.
Bookings must be secured by a 30% deposit within 7 Days upon confirmation with the balance payable 45 days prior to arrival.
*Bookings Payment & Cancellation Policies.
30% non-refundable deposit 7 days after confirmation
50% payments due and 50% cancellation fees apply 60 days before travel
100% payment due and 100% cancellation fees apply 35 days before travel
*These clauses are applicable to all bookings.
TRADING TERMS & CONDITIONS.
*Amendment in rates.
Prices are subject to change without prior notification. Prices are also subject to change in the event of changes in government imposed taxes, fuel price, hotel charges, tourism levies and or the introduction of national, regional or local taxes or levies of whatever nature.
* Refunds.
Whilst the company uses its best endeavors to ensure that all anticipated accommodation is available as planned, there shall be no claim whatsoever against the company for a refund either in whole or a part, if any accommodation or excursion is unavailable, or the passenger was unable to use this service for whatever reason.
* Confidentiality.
The AGENT confirms and agrees that the contents of this agreement are strictly confidential to the undersigned and that no part of this agreement in any form may be divulged to a third party.
* Variation.
The contractual terms mentioned in this agreement are subject to change without notice; however, every effort will be made to maintain them. In the event of a change in rates offered by Third Part Suppliers and/or a change in Government Taxes or Levies affecting the rates or terms mentioned herein, Hodari Africa Safaris Limited reserves the right to pass on any increases to the AGENT.
* Liability.
The AGENT agrees to indemnify, defend and hold harmless Hodari Africa Safaris Limited, the owners, and their respective affiliates, directors, officers, employees, AGENTs and assigns of each from and against any and all damages, losses, claims, demands, suits, proceedings, judgments, losses or expenses (including, without limitation, costs, attorneys’ fees and fees of other professionals) on any nature whatsoever (whether based in tort, breach of contract, product liability, patent or copyright infringement, or otherwise) arising directly or indirectly from or out of the performance or operation of this Agreement including their respective activities.
* Levies & Taxes.
Rates are inclusive of current taxes and levies.
* Travel & Medical Insurance.
It is a condition of using the rates and services offered by Hodari Africa Safaris Limited that all AGENTs & Clients (including individuals, companies and other legal (entities) have in place adequate insurance cover against all risks associated with travel in Africa and it is a requirement of using the services offered by Hodari Africa Safaris Limited that all AGENTs & Clients (including individuals, companies and other legal entities) take out appropriate travel, medical and other insurance prior to departure of AGENTs & Clients from their country of origin. A visit to Africa and particularly a Safari entails an element of risk and neither Hodari Africa Safaris Limited nor their officers and employees shall be liable in way for any loss or damages expenses or costs arising from any incident involving AGENTs & Clients (individuals, companies and other legal entities) that may occur whilst using any of the services provided by Hodari Africa Safaris Limited or third parties contracted by Hodari Africa Safaris Limited.
It is the responsibility of every AGENT & Client (including individuals, companies and other legal entities) to assess their own insurance requirements and to organize appropriate insurance. In the event of failure of any AGENT & Client (individual, company or other legal entity) to comply with these insurance conditions and requirements or to organize appropriate insurance then neither Hodari Africa Safaris Limited nor their officers or employees nor any third party contracted by Hodari Africa Safaris Limited shall be liable in any way for any loss or damages expenses or costs arising from any incident.
* Collection & Processing of Personal Data & Privacy Policy.
By signing these terms and conditions the AGENTs confirms and consent to the collection and processing of his/her/their personal data as per our privacy policy published on our website at www.hodariafricacollection.com/data-privacy-policy or has received a copy of our Privacy Policy Document.
PAYMENT METHODS AND BANK DETAILS.
Payments via credit card (Master/Visa/Amex/Diners), Electronic Transfer, or SWIFT:
Payment should be made directly into the bank account listed below, please use HASLMQ2024 as the reference on the payment a copy of the remittance advice together with the above booking number must be emailed to accounts@hodarikenya.co.ke and sam@hodarikenya.co.ke
